摘要:
“上海迪士尼乐园案”反映了消费者自主选择权与经营者自主经营权的冲突。该冲突的争议焦点在于“禁止自带”条款,通过加强经营者告知义务、完善行业规范与市场自律、实现消费者自我意识觉醒等解决争议,既保护消费者权益,又保障市场经济健康发展。
Abstract:
Taking Shanghai Disneyland case as an example, this thesis discusses the conflict between consumers right to choose and operators  right to operate. The focus of the conflict lies in the prohibition of self bringing clauses. Strengthening the operators obligation to inform, perfecting the industrial standard and market discipline, and realizing the self awakening of consumption and so on to deal with the conflict not only protect the rights and interests of consumers, but also ensure the healthy development of the market economic order.
